Appendix: Thailand Privacy Policy

In addition to Privacy Policy for MMC Hardmetal (Thailand) Co., Ltd. (“Global Privacy Policy”) which applies to all of you, this country-specific exhibit, “Thailand Privacy Policy”, will also apply to Thai residents. If the Global Privacy Policy conflicts with this Thailand Privacy Policy, the Thailand Privacy Policy will prevail.

This Thailand Privacy Policy is in compliance with Thailand’s Personal Data Protection Act, B.E. 2562 (2019) and other applicable personal data protection laws and regulations (“PDPA”). The Thailand Privacy Policy applies when MMC Hardmetal (Thailand) Co., Ltd. acts as the data controller of the personal information only.

1. HOW WE COLLECT YOUR PERSONAL INFORMATION AND WHAT IS THE RESULT IF YOU DO NOT PROVIDE SUCH PERSONAL INFORMATION

We collect your personal information directly from you in a variety of contexts, including a case when you or your company provides to us to perform certain transactions or obligations such as activities related to services. 
We may also indirectly collect personal information from Google, which is the provider of web analytics services about the usage of the website (Google Analytics) or from Geolocation Technology, which is the IP geolocation database provider. In any case, this information is mostly statistical and for analytics purpose.  

2. PURPOSE

We process your personal information described above to: (i) perform contractual obligations as a party to the contract, (ii) for the legitimate interest, or (iii) your consent to the collection, use, and transfer of your personal information, in accordance with the PDPA.

We will ask for your consent before processing your personal information for the following purposes:

• Personalizing (including the analysis of your pursuits, interests, and needs) information we provide to you about our services and products based on your interaction with our website;
• Operating sales and marketing activities (including marketing activities using analysis of your pursuits, interests, and needs);
• Developing (including planning and development using analysis of your pursuits, interests, and needs) our new products and services;

3. SENSITIVE PERSONAL INFORMATION

We usually do not collect sensitive categories of your personal information (e.g., racial or ethnic origin, religious or philosophical beliefs, health data), as defined under the PDPA. If we cannot avoid collecting sensitive categories of your personal information, we will take the necessary measures according to the PDPA to legally collect such information and/or obtain consent from you.

4. PERSONAL INFORMATION OF CHILDREN

We have no intention to process the personal information of those under 20 years of age. If we need to collect the personal information of a child, we will take the necessary measures according to the PDPA, such as obtaining the consent of the parent or legal guardian.

Regardless, please note that we cannot, however, in all circumstances, accurately verify the age of all website users. As such, we request that such relevant legal representative contact us via channels as provided in this Thailand Privacy Policy, to provide consent to us or to help us remove his/her personal data from our websites. 

5. RETENTION (how long do we retain your personal information?)

We retain your personal information described above as long as it is necessary for the purposes described above and consistent with the PDPA.

6. YOUR LEGAL RIGHTS

In addition to the Global Privacy Policy, you have the following rights with your personal information as set out in the PDPA:

• Right to data portability - You have the right to ask that we transfer the personal information you gave us to another, or give it to you.
